Cop arrested for assault after alleged North Carolina DWI accident

A 38-year-old man is accused of drunk driving after allegedly bumping the rear of an automobile that was stopped at a red light in Matthews Dec. 7. No injuries were involved in the rear-end collision. What followed the alleged drunk driving accident is not the usual story of a DWI investigation. Police say the woman driving the car that was struck called her son–a Charlotte Mecklenburg police officer. He was nearby the accident scene in Matthews and arrived before on-duty police were able to respond.

The man accused of drunk driving says he never saw the woman’s son arrive. He says he was trying to speak to the driver of the other vehicle involved in the rear-end collision when he was grabbed from behind and thrown to the ground. The son of the driver, who is a Mecklenburg Police officer, was subsequently charged with assault for his alleged involvement in the case.

Sources close to the officer’s family say the man accused of DWI was banging on the window. The cop, whose mother and 8-year-old son were in the car, apparently claims that he was protecting his family, according to friends of the officer’s family. Sources say the officer’s mother thought the man accused of DWI was drunk and she was afraid of what he might do if she opened her car window.

Police say they obtained breath and blood samples from the man accused of DWI. He faces DWI and open container charges. He required treatment at an area hospital after the alleged assault. He reportedly has been released from custody.

The Charlotte-Mecklenburg officer is facing an assault, inflicting serious injury, charge after the encounter. He reportedly turned himself in to the Magistrate’s Office Friday and was released on ,500 bond.

Man arrested on North Carolina DWI charges in Ambien case

When people in North Carolina hear news of an arrest for driving while impaired, most probably think of a drunk driving arrest. The truth of the matter is that North Carolina DWI laws may extend to any number of substances that impair a person’s normal faculty to drive an automobile.

The North Carolina Highway Patrol says they responded to a single-vehicle accident last Wednesday involving a car that apparently hit a ditch. The accident reportedly occurred around 8:30 p.m. Law enforcement claims the trooper who responded to the crash site suspected the driver may have been “under the influence of prescription medications.”

The driver, a district court judge who has served on the bench in Lenoir and Greene counties, apparently takes Prilosec and zolpidem, a generic form of the sleeping aid Ambien. After investigation the solo-car accident, the trooper arrested the judge on suspicion of DWI.

News reports suggest the judge takes the zolpidem on a nightly basis. However, the news does not indicate if the judge took any before the 8:30 p.m. accident, and if so, the news does not indicate when that medication was allegedly taken.

Law enforcement says that they obtained a blood sample from the driver on the night of the accident. Toxicology tests on the blood sample are expected to be conducted by the State Bureau of Investigation. Results of the tests are not expected for a matter of weeks.

The driver reportedly says he did not feel impaired before venturing out to pick up a ham from a friend’s house. The accident apparently occurred during the return trip that evening. The one-vehicle accident apparently occurred in an instant.

Matt Hardy arrested twice for DWI in North Carolina

Former professional wrestler Matt Hardy has been arrested for the second time in less than a month for DWI in North Carolina. The latest incident occurred Monday at Raleigh-Durham International airport. Airport police reportedly received a tip that a red Camaro was swerving and was nearly involved in an accident.

Police responded and reportedly stopped a Camaro. The former wrestler was reportedly behind the wheel. Law enforcement says Hardy submitted a breath test sample, which showed no presence of alcohol. However, law enforcement says he failed a field sobriety test after the traffic stop.

Law enforcement reportedly called in a drug recognition officer from the North Carolina Highway Patrol. The drug recognition officer claims Hardy was under the influence of drugs, according to police reports. Hardy was arrested for DWI. A blood sample was reportedly drawn, but results of that test remain pending. Hardy was released on his own recognizance from the Wake County Detention Center. He is scheduled to appear in court on the second DWI charge November 30.

Hardy was arrested on August 20 in Moore County on suspicion of DWI. In that incident police say Hardy crashed a Corvette into a tree. A North Carolina State Trooper says in the August incident a breath test also did not detect the presence of alcohol. Police claim the former professional wrestler appeared to be under the influence of a substance. Hardy is scheduled in court on September 28 related to the earlier DWI charges.

North Carolina man riding bicycle arrested on suspicion of DWI

Graham police say they received a call from a person who was worried about a man on a bicycle. An officer reportedly went to the area where the caller says the bicyclist was located. The officer says he watched the bike rider swaying as he rode down North Carolina 54.

The officer says he watched the man as he rode for about a half-mile. The officer believed the 46-year-old man appeared intoxicated, so he pulled the bike rider over. Graham police say the bike rider refused to submit to an alcohol breath test and the man was arrested on suspicion of DWI.

North Carolina law allows for the state to seek full DWI charges for people suspected of riding a bicycle or lawn mower who are allegedly impaired under the DWI laws. The standards remain the same as with traditional motor vehicles. North Carolina presumes impairment if an alcohol test returns a result of .08 blood alcohol content or greater. Additionally, law enforcement can testify as to their observations during an encounter with a person suspected of driving drunk.

In many cases a test refusal can result in the loss of driving privileges in North Carolina. Typically test refusal cases result in an automatic 30-day revocation, with the potential for a driver’s license revocation of one-year after the opportunity for a hearing. Rapper Flo Rida arrested on suspicion of DWI

Law enforcement claims that when they signaled the driver of a .3 million Bugatti Veyron to pull over for alleged erratic driving; the car continued swerving for another two blocks. Police approached the vehicle and identified the driver as rapper Flo Rida, whose real name is Tramar Dillard. Rida is best known for his 2008 hit “Low” featuring T-Pain and his smash, “In the Ayer,” which features Will.i.am.

Law enforcement approached the vehicle and claim the musician exhibited bloodshot eyes. Law enforcement claims the man was slurring his speech during the encounter. Police asked Rida to step out to perform field sobriety tests. The officer says Rida admitted he would have trouble walking a straight line because he had had a few drinks before driving. The rap star submitted to a Breathalyzer test, which police say show a breath alcohol content of .18, more than twice the legal limit. The rap star was placed under arrest for DWI.

In addition to the DWI charge, Rida also faces a charge for driving on a suspended license. The man’s driving privilege reportedly was suspended for an unpaid traffic ticket.

Before being arrested, Rida reportedly asked the officer if he could walk home from the location of the traffic stop. He reportedly lives near-by. After police initially started the DWI investigation, a crowd formed. The bystanders pleaded with law enforcement to let the rap star go free. One bystander offered to drive Rida home.

The musician was transported to the local jail where bail was set at ,000.

Two Marines arrested under new North Carolina synthetic drug law

Last Wednesday, a new law took effect in North Carolina banning the sales, manufacture or possession of synthetic forms of marijuana or cocaine, also known as spice and bath salts. That same day two Marines stationed at Camp Lejeune were arrested after a car wreck in Jacksonville. An 18-year-old marine who reportedly was driving a 2009 Ford Fusion involved in the wreck now faces North Carolina charges, including driving while impaired.

Jacksonville Police say the 18-year-old crashed the Ford into a truck sales building in Jacksonville around 4:25 p.m. After crashing into the building, law enforcement says the driver backed away from the crash and re-entered traffic. The Ford reportedly travelled to N.C. 24, where the driver is accused of entering traffic in the wrong direction.

The Ford reportedly struck several vehicles on the highway before crossing the median, three traffic lanes and the bicycle path. Police say the Ford then slammed into the Camp Lejeune fence. No injuries are reported from the alleged incident.

Jacksonville Police claim the driver and a 21-year-old passenger admitted to police after the incident that they had been smoking spice. Police arrested both men after the alleged incident.

The 18-year-old driver has been charged with DWI and careless driving. The 21-year-old passenger, who is also a Marine, was charged with possession of a controlled synthetic cannabanoid known as spice.

The driver was held in the Onslow County Jail. The passenger was cited for the alleged drug offense and released into the custody of Camp Lejeune authorities.

The alleged incident and the charges all occurred on the first day that the new law banning certain synthetic drugs, such as spice, went into effect in North Carolina.

Woman allegedly tries to ram Wake County bar, arrested for DWI

The North Carolina Highway Patrol claims that a 35-year-old Garner woman is facing DWI charges after she tried to ram her car into a Wake County nightclub Thursday. The woman reportedly drove off and was later taken into custody in Johnston County. Authorities say the woman is charged with driving while impaired and reckless driving, however, law enforcement claims further charges remain pending.

Sgt. Jeff Gordon, spokesman for the North Carolina Highway Patrol says law enforcement was alerted to an incident at a Wake County nightclub just after 2 a.m. Thursday. Workers at the nightclub reported that a woman parked in front of the bar and entered to order a drink. Because the employees believed the woman was intoxicated, they claim they refused to serve her.

The owner of the bar says the woman left the nightclub and then walked back in a short time later and threatened to “roll into the bar.” A short time later, the employees say the woman crashed her blue Honda Accord into a picnic table in front of the establishment. The picnic table reportedly knocked down a support column for a canopy in front of the bar. Two women sitting at the picnic table were not injured.

Workers at the bar say the woman then fled, hitting a car in the parking lot on her way out. Johnston County sheriff’s deputies received a report of a blue Honda Accord that had run off the road and landed in a ditch along NC 50. Law enforcement responded to the scene and took the 35-year-old Gaston woman into custody. Law enforcement claims the woman was belligerent and assaulted an emergency responder at the accident scene and a doctor at the Johnston Memorial Hospital.

The News and Observer reports the woman has faced DWI allegations previously in three separate North Carolina Counties dating back to 1999.
